General conditions of sale

Article 1: Preamble

These General Conditions of Sale (GTC) govern the contractual relations between AMETIS EURL, Siret 45334343600011, whose registered office is located at 162 rue Jean Moulin, 38490 Saint-André-le-Gaz (hereinafter referred to as « the Seller ») and any natural or legal person (hereinafter referred to as « the Customer ») making a purchase of raw materials via the Chad Agri Sourcing website.

Any order placed on the Chad Agri Sourcing website implies the full acceptance of these Terms and Conditions, effective 1 January 2025.

Article 2: Products

Products offered for sale are agricultural and natural raw materials imported from Chad, in particular but not exclusively: arabic gum, sesame, chebe, moringa, etc. The essential characteristics of the products are presented on the Chad Agri Sourcing website. Photographs and descriptions are not contractual and may vary.

Article 3: Order

The Customer can place an order directly on the Chad Agri Sourcing website or by direct contact (e-mail, telephone). For any order, a personalized estimate will be established. The order is considered final only after acceptance of the estimate by the Customer and payment of the agreed deposit.

Article 4: Prices

The prices of the products are shown in euro (€) excluding taxes. They do not take into account the costs of transport, insurance and customs, which are borne by the Customer. The applicable price is that in force at the time of the order.

Article 5: Payment methods

Payment shall be made by bank transfer or any other means of payment agreed between the parties. A deposit can be requested at the time of the order, the balance being payable upon receipt of the goods. Late payment will automatically result in late payment penalties calculated on the basis of the increased statutory interest rate.

Article 6: Delivery

Delivery is made by a carrier chosen by mutual agreement between the Seller and the Customer. Delivery times are indicative and may vary depending on customs and logistical constraints. The Seller disclaims any liability for delay in delivery. The transport risks are transferred to the Customer as soon as the goods are removed.

Article 7: Receipt of Goods

It is the responsibility of the Customer to verify the condition of the packages and the conformity of the goods with the reception. Any reservation must be made in writing on the delivery note and confirmed to the carrier by registered letter with acknowledgement of receipt within 48 hours. A copy of this letter must be sent to the Seller within the same period.

Article 8: Major Force

The Seller may not be held liable in the event of failure or delay in the performance of his obligations due to a case of force majeure, as defined by French jurisprudence.

Article 9: Applicable law and Disputes

These Terms and Conditions are subject to French law. In the event of a dispute, the parties shall endeavour to find an amicable solution. Otherwise, the competent courts in Grenoble will have sole jurisdiction.

Article 10: Personal data

The personal data collected via the Chad Agri Sourcing website are processed in accordance with the applicable data protection legislation. They are only used in commercial relations between the Seller and the Customer. In accordance with the GDPR, the Customer has the right to access, rectify and delete the data concerning him, by contacting the Seller by e-mail at the address contact@tchadagrisourcing.com.
